TERMS OF SERVICE

Welcome to Kippush ("Kippush", "we", "our", or "us").

These Terms of Service govern your use of kippush.ca and purchases made through our online store. By using our website or placing an order, you agree to these Terms, subject to any rights you may have under applicable law.

1. Eligibility

You must have the legal capacity to enter into a purchase agreement or have the authorization of a parent or legal guardian where required by law.

2. Products and Services

Kippush offers products including personalized and custom kippahs, shawls, blank products, ready-made designs, and related custom products and services.

Product availability, colours, designs, customization options, pricing, and quantities may change from time to time.

We may modify or discontinue products or services, subject to orders and obligations already accepted by us and applicable law.

3. Custom and Personalized Orders

Many Kippush products are personalized or produced according to customer specifications.

Customers may provide information including:

  • Names

  • Dates

  • Text

  • Logos

  • Artwork

  • Images

  • Design instructions

  • Other personalization details

Customers are responsible for reviewing information and files they submit and for notifying us of any errors as soon as possible.

Kippush is not responsible for errors originating solely from incorrect information or artwork supplied and approved by the customer, subject to applicable consumer protection laws.

4. Customer Artwork and Intellectual Property

When you submit a logo, artwork, photograph, design, trademark, or other content to Kippush for reproduction, you confirm that you own the content or have the necessary permission or authority to use and reproduce it for your order.

You agree not to knowingly submit content that infringes another person's copyright, trademark, privacy, publicity, or other applicable rights.

Kippush may refuse to reproduce submitted content where we reasonably believe that doing so may violate applicable law or third-party rights.

To the extent permitted by applicable law, customers are responsible for claims arising directly from content they supplied without the necessary rights or permissions.

Submitting content for production does not transfer ownership of that content to Kippush.

5. Digital Proofs and Design Approval

For certain custom orders, Kippush may provide a digital proof before production.

Customers are responsible for reviewing the proof carefully, including:

  • Names and spelling

  • Dates

  • Text

  • Colours

  • Logos and artwork

  • Placement

  • Other personalization details

Where approval is required, production may begin after the customer approves the digital proof.

Once production has begun, further modifications may not be possible.

The approved proof serves as the production reference.

Approval does not limit any rights you may have if the finished product is defective, damaged, or does not reasonably conform to the approved design.

6. Bulk Orders

Bulk orders for events, synagogues, organizations, schools, camps, businesses, and other groups may be subject to special pricing, proofing requirements, production schedules, or payment arrangements.

Unless otherwise agreed with Kippush, payment may be required before custom production begins.

For larger custom orders, additional proofing or physical sample options may be available upon request.

Customers with a specific event date or deadline should contact us before ordering so that we can confirm the expected production and delivery timeline.

Custom bulk orders generally cannot be cancelled after production has begun, except where cancellation or other remedies are required by applicable law.

7. Pricing and Taxes

Prices displayed on kippush.ca are in Canadian dollars (CAD) unless otherwise indicated.

Prices may change from time to time. A price change will not retroactively change the price of an order already accepted by Kippush, except where permitted or required by law.

Applicable taxes, shipping charges, and other applicable charges will be presented as required during the purchase process.

8. Payment

Payments are processed through the payment methods made available through our Shopify store.

Payment processing may be performed by Shopify or other applicable payment providers.

Kippush does not directly store complete payment card information on its own servers.

An order may not proceed if payment cannot be successfully authorized or completed.

9. Production Times

Most personalized and custom products require production before shipment.

For custom kippahs, production generally takes approximately 1–3 business days after artwork or digital proof approval.

Production times are estimates and may vary depending on factors including:

  • Order quantity

  • Design complexity

  • Inventory availability

  • Current production volume

  • Holidays

  • Events beyond our reasonable control

If you have a specific event date or deadline, please contact us before ordering so we can confirm the expected timeline.

10. Shipping and Delivery

Kippush currently ships within Canada and the United States.

Available shipping methods, carriers, charges, and estimated delivery times may vary depending on the destination and order.

Delivery estimates are not guarantees unless a specific delivery commitment has been expressly confirmed in writing.

Carrier delays, weather, customs processing, holidays, and other events outside our reasonable control may affect delivery.

If an order is lost, damaged, or significantly delayed in transit, please contact us so that we can assist with the appropriate investigation or resolution.

Nothing in these Terms limits any delivery, cancellation, refund, or other rights available under applicable consumer protection laws.

11. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy and applicable law.

Because personalized and custom products are produced according to customer specifications, they are generally not eligible for return or refund because of a change of mind after production has begun.

This does not affect your rights regarding defective, damaged, incorrect, or non-conforming products or any other rights provided by applicable law.

12. Legal Warranties

Products sold by Kippush are subject to legal warranties and other protections provided by applicable law.

Nothing in these Terms excludes, restricts, or replaces any legal warranty or consumer right that cannot lawfully be excluded.

13. Customer Files and Reorders

Kippush may retain customer-provided artwork, design files, proofs, and order-related information where reasonably necessary for:

  • Production

  • Customer service

  • Reorders

  • Resolving order issues

  • Business records

  • Legal or accounting obligations

Retention and handling of personal information are governed by our Privacy Policy and applicable privacy laws.

Kippush does not guarantee that production or design files will be retained indefinitely.

14. Product Photography and Portfolio Use

Kippush may photograph products we produce for internal quality control and business records.

We will not use customer-provided personal photographs, private artwork, or personally identifying information for public advertising or promotional purposes without appropriate authorization.

Where appropriate, we may request permission to feature completed customer projects in our website Gallery, portfolio, social media, or other promotional materials.

15. Website Content

The content on kippush.ca, including Kippush branding, website design, graphics, photographs owned by Kippush, text, and original materials, may be protected by intellectual property laws.

You may use the website for personal shopping and informational purposes.

You may not reproduce, distribute, commercially exploit, or misuse Kippush-owned website content without authorization, except as permitted by applicable law.

16. Limitation of Liability

To the extent permitted by applicable law, Kippush will not be liable for indirect or consequential losses arising solely from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability, warranties, remedies, or consumer rights where such exclusion or limitation is prohibited by applicable law.

17. Events Beyond Our Reasonable Control

Kippush is not responsible for delays caused by events beyond our reasonable control, which may include severe weather, transportation disruptions, power or internet outages, labour disruptions, government actions, supplier disruptions, or similar events.

If such an event materially affects an order, we will make reasonable efforts to communicate with the customer and determine an appropriate next step.

This section does not limit any rights or remedies provided by applicable law.

18. Privacy

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy.

19. Quebec and Canadian Consumer Rights

Nothing in these Terms is intended to waive, restrict, or exclude any right or remedy that cannot lawfully be waived under applicable federal or provincial law, including Quebec's Consumer Protection Act.

Where applicable law provides greater protection than these Terms, the applicable law will prevail.

20. Governing Law

These Terms are governed by the laws applicable in the Province of Quebec and the applicable laws of Canada.

Nothing in these Terms requires a Quebec consumer to waive any jurisdiction, venue, or other procedural right provided by applicable law.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, services, or legal obligations.

The current version will be posted on this page with its "Last Updated" date.

Changes will apply in accordance with applicable law and will not retroactively remove rights relating to an order already placed where prohibited by law.
